Board of Psychology

The Board of Psychology hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver, filed on April 9, 2013, by Tasha A. Hibbert. The Notice of Petition for Waiver or Variance was published in Vol. 39, No. 80, of the April 24, 2013, Florida Administrative Register. Petitioner was seeking a variance or waiver of paragraph 64B19-11.001(4)(b), Florida Administrative Code, which states that a passing score on the Florida laws and rules examination shall cease to be valid eighteen (18) months after the Board's letter to the applicant advising that the applicant has passed the Florida laws and rules examination.

The Board’s Order, filed on July 15, 2013, denied the petition finding that Petitioner has not established that the purpose of the underlying statute, Section 490.005, Florida Statutes, would be met were the Petitioner to be granted a variance from the rule. Additionally, the Petitioner does not demonstrate how the rule creates a substantial hardship or how it violates the principles of fairness.
