The Board of Medicine hereby gives notice that on August 18, 2017, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed on behalf of Publix Super Markets, Inc., on May 31, 2017, seeking a waiver or variance from paragraph 64B8-44.002(3)(j), F.A.C., with regard to the requirement that the dietician be identified by name in the advertising of dietician/nutrition services. The Notice was published in Volume 43, No. 107, of the Florida Administrative Register, on June 2, 2017. The Board, at its meeting held on August 4, 2017, voted to grant the Petition for Waiver finding that the Petitioner demonstrated a substantial hardship; that application of the rule would violate the principles of fairness; and that the purpose of the underlying statute has been met.
