The Board of Chiropractic Medicine hereby gives notice:
of the issuance of an Order regarding the Petition for Variance or Waiver, filed on March 9, 2018, Richard Hodish, D.C., and Nathalie DiGiorgio, D.C. The Notice of Petition for Variance or Waiver was published in Vol. 44, No. 50, of the March 13, 2018, Florida Administrative Register. Petitioners sought a variance of subsection 64B2-13.004(2), F.A.C., which requires that for the purpose of renewing a license, only those classroom hours earned at Board approved continuing education courses or under the provision of the rule are acceptable. Petitioners sought approval to take an online CE course which has not previously been approved by the Board. The Board considered the Petitions at a duly-noticed public meeting held on May 18, 2018, in Kissimmee, FL. The Board’s Orders, filed on August 9, 2018, denied the petitions because Petitioners failed to demonstrate how compliance with subsection 64B2-13.004(2), F.A.C., requiring Petitioners to take Board approved courses, would pose an undue hardship or violate principles of fairness.
