NOTICE IS HEREBY GIVEN THAT on August 21, 2019, the Board of Medicine issued a Final Order on the petition for declaratory statement filed on behalf of Ralph Zipper, M.D. The Notice of the Petition was published in Volume 45, No. 69, of the April 9, 2019, issue of the Florida Administrative Register. The Board reviewed the Petition at its meeting held on June 7, 2019. The Board’s Final Order finds that the Petitioner’s use of the device as set forth in his petition does not constitute a prohibited referral under the Patient Self-Referral Act. Additionally, the Petitioner’s use of the device on his patients and his compensation from the manufacturer are not precluded under Sections 817.505 or 456.054, Florida Statutes.
