    64B12-9.016Eligibility of Individuals Licensed in Another State

    The Board of Opticianry hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed on February 28, 2019, by Michelle Sousa. The Notice of Petition for Waiver or Variance was published in Vol. 45, No. 44, of the March 5, 2019, Florida Administrative Register. Petitioner sought a waiver of Rule 64B12-9.016, F.A.C., which requires that applicants be actively licensed to practice opticianry, in another state, territory, or jurisdiction of the United States, for a period of more than 3 years immediately preceding application. Petitioner was previously licensed in another state, however, has been unable to provide documentation which shows that she was actively practicing opticianry in another state for more than 3 years immediately preceding the application. The Board’s Order, filed on May 24, 2019, voted to deny the petition of variance or waiver finding that the Petitioner did not meet the purpose of the underlying statute by other means and that the application of the rule to Petitioner did not create a substantial hardship or violate the principles of fairness.
