Construction Industry Licensing BoardNOTICE IS HEREBY GIVEN THAT on January 20, 2006, the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Dannie S. Johnson on October 4, 2005. The following is a summary of the agency's disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Vol. 31, No. 43, of the October 28, 2005, F.A.W. The Petitioner sought the Board’s interpretation of Section 489.113(9), Florida Statutes, entitled “Qualifications for practice; restrictions” and whether a licensed Residential or Commercial Swimming Pool Contractor, in accordance with Section 489.113(9), F.S., include in his contract the sale of a screen enclosure which will be subcontracted to an appropriately licensed contractor for installation. The Board considered the instant Petition at a duly-noticed public meeting, held November 9-11, 2005, in Naples, Florida. The Board’s Order answered that if the majority of the work within the contract is within the scope of the Residential or Commercial Swimming Pool contractor, the contractor may include in his contract the sale of a screen enclosure, which will be subcontracted to an appropriately licensed contractor for installation.
