APPROVING CITY OF GROVELAND ORDINANCE NO. 2018-06-16
The Department of Economic Opportunity (“Department”) hereby issues its Final Order, pursuant to subsection 380.05(6), Florida Statutes, approving land development regulations adopted by the City of Groveland, Florida, Ordinance No. 2018-06-16 (the “Ordinance”).
FINDINGS OF FACT
1. The Green Swamp Area is designated by section 380.0551, Florida Statutes, as an area of critical state concern. The City of Groveland (“City”) is a local government within the Green Swamp Area.
2. The Ordinance was adopted by the City on July 2, 2018, and rendered to the Department on July 5, 2018.
3. The Ordinance amends the Groveland Code of Ordinances to add Article III in Chapter 101, which establishes public notice requirements, in addition to those required by state law, to provide its residents, businesses, and land owners within the City the opportunity to be notified of land use measures or deviations from the City’s land development use and development regulations coming before the land planning agency or City council.
CONCLUSIONS OF LAW
4. The Department is required to approve or reject land development regulations that are adopted by any local government in the Green Swamp Area of Critical State Concern.

5. “Land development regulations” include “local zoning, subdivision, building, and other regulations controlling the development of land.” Subsection 380.031(8), Florida Statutes. The regulations adopted by the Ordinance are land development regulations.
6. The Ordinance is consistent with the City’s Comprehensive Plan generally, as required by subsection 163.3177(1), Florida Statutes, and is not inconsistent with any specific policies.
7. All land development regulations enacted, amended, or rescinded within an area of critical state concern must be consistent with the principles for guiding development for that area. See subsection 380.05(6), Florida Statutes. The Principles for Guiding Development for the Green Swamp Area of Critical State Concern are set forth in subsection 28-26.003(1), Florida Administrative Code.
8. The Ordinance is consistent with the Principles for Guiding Development as a whole, and is not inconsistent with any principles.
WHEREFORE, IT IS ORDERED that the Department finds that the City of Groveland Ordinance No. 2018-06-16 is consistent with the City of Groveland Comprehensive Plan and the Principles for Guiding Development for the Green Swamp Area of Critical State Concern and is hereby APPROVED.
This Order becomes effective 21 days after publication in the Florida Administrative Register unless a petition is timely filed as described in the Notice of Administrative Rights below.
