DEPARTMENT OF FINANCIAL SERVICES

NOTICE IS HEREBY GIVEN that the Department of Financial Services has received a petition for declaratory statement from Concept Special Risks, Inc. on August 7, 2014. The petition seeks the agency’s opinion as to the applicability of Section 626.112(8), Florida Statutes, or any other provision of Chapter 626, Florida Statutes (or rules promulgated thereunder), as it applies to the petitioner.

The Petition seeks the agency’s opinion as to whether Section 626.112(8), Florida Statutes, or any other provision of Chapter 626, Florida Statutes (or rules promulgated thereunder) prohibit its proposal to enter into an arrangement with a manufacturing entity whereby the manufacturer would provide Concept Special Risks, Inc. with its customer list to use to solicit business with a portion of any commission earned being donated to a charity (the Wounded Warrior Project); and further to make the arrangement a focus of advertisement by the manufacturer and Concept Special Risks, Inc.
