    PURPOSE AND EFFECT: To establish procedures for school districts to plan and document delivery of required instruction related to s. 1003.42(2), F.S., for grades K-12 students.

    SUMMARY: School districts must annually submit an annual report documenting instruction for students in grades K-12 related to their implementation of the required instruction in s. 1003.42(2), F.S.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: This new rule is not expected to have any adverse impact on economic growth, business competitiveness or any other factors listed in s. 120.541(2)(a), F.S., and is not expected to require legislative ratification. All of the topics of instruction have been required in statute for years, so there should be no additional cost for the instruction itself. The reporting requirements may impose some additional indeterminate costs on school districts; however, it is anticipated that districts will will be able to do the reporting with existing resources. Moreover, it is expected that after the first reporting year the burden will be minimized, since the information will largely be the same.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    6A-1.094124 Required Instruction Reporting

    (1) In order to provide information about the manner in which the prescribed courses of study set forth in section 1003.42(2), F.S., are provided by school districts, by July 1 of each year, each school district must submit a report to the Commissioner of Education that describes how instruction was provided for topics in section 1003.42(2)(a)-(n) and (p)-(t), F.S., during the previous school year.

    (2) This report shall contain:

    (a) The specific courses in which instruction will be delivered for each grade level; and

    (b) A description of the materials and resources utilized to deliver instruction.

    (3) Failure to comply with the requirements of this rule may result in the imposition of sanctions described in Section 1008.32, F.S.
