    PURPOSE AND EFFECT: The purpose of the rule chapter is to establish the Westview South Community Development District (CDD).

    SUMMARY: The proposed Westview South CDD is to consist of 1,015.431 acres in Osceola and Polk Counties. The land is generally located northwest of the intersection of Poinciana Parkway and Cypress Parkway. The initial members of the Board of Supervisors of the CDD are to be: Heather Isaacs, Nora Schuster, Damon Cascio, Julie Aragona, and Jeff Stalder.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    However, a SERC was completed at the request of the Petitioner and is contained as Exhibit 7 in the Amended Petition.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Commission has determined that the proposed rule chapter is not expected to require legislative ratification based upon the SERC completed at the request of the Petitioner.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    The boundaries of the district are those set forth in Exhibit “2” to the Amended Petition to Establish the Westview South Community Development District filed with the Commission on March 14, 2022 (“Amended Petition”), under Commission Case Number CDD-21-005. The Petition to Establish the Westview South Community Development District was filed with the Commission on November 29, 2021 (“Petition”) and revised on January 6, 2022 (“Revised Petition”). The Amended Petition is hereby incorporated by reference, and available at http://www.flrules.org/Gateway/reference.asp?No=Ref-XXXXX and copies of which are available by contacting the Clerk of the Florida Land and Water Adjudicatory Commission at Office of the Governor, Room 1802, The Capitol, Tallahassee, Florida 32399-0001.
