64B12-16.008: Enforcement

The Board of Opticianry hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver for Lydia Schmidt, filed on December 14, 2012. The Petitioner was seeking a permanent variance or waiver of Rule 64B12-16.008, F.A.C., with regards to the time limit an Apprenticeship Sponsor Attestation form must be provided to the Board. The Notice of Petition for Variance or Waiver was published in Volume 39, No. 1, of the January 2, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held telephonically, on June 7, 2013.

The Board’s Order, filed on July 3, 2013, denies the Petition for Variance or Waiver. The Board determined that the Petitioner has not demonstrated that application of the rule would create a substantial hardship or violate the principles of fairness.
