    Board of Massage Therapy

    The Board of Massage Therapy hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver, filed on April 3, 2015, by Michelle Daniel. The Notice of Petition for Waiver or Variance was published in Vol. 41, No. 69, of the April 9, 2015 Florida Administrative Register. Petitioner sought a variance or waiver of the rule requiring that 12 hours of continuing education courses for licensure renewal be in the presence of an instructor and include hands-on participation by the licensee and/or demonstration by the instructor. The Board considered the instant Petition at a duly-noticed public meeting held on June 10, 2015, by telephone conference call.

    The Board’s Order, filed on June 16, 2015, grants the petition for a waiver or variance of Rule 64B7-29.009, F.A.C., stating that the Board found that the petition was in substantial compliance with the provisions of Section 120.542, F.S., and Chapter 28-104, F.A.C. The Applicant has met the purpose of the underlying statute, and the application of the rule to Petitioner in her circumstances would create a substantial hardship and violate the principles of fairness.
