The Board of Massage Therapy hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver, filed on June 16, 2015, by Sarah Garay. The Notice of Petition for Waiver or Variance was published in Vol. 41, No. 118, of the June 18, 2015 Florida Administrative Register. Petitioner sought a variance or waiver of Rule 64B7-28.009, F.A.C., regarding live attendance at continuing education courses. The Board considered the instant Petition at a duly-noticed public meeting held on July 17, 2015, in Kissimmee, Florida.
The Board’s Order, filed on August 11, 2015, grants the petition for the biennium ending on August 31, 2015, stating that the Board Found that the petition was in substantial compliance with the provisions of Section 120.542, F.S., and Chapter 28-104, F.A.C. The Applicant has met the purpose of the underlying statute, and the application of the rule to Petitioner would cause a substantial hardship.
