Board of Nursing

The Board of Nursing hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed on May 30, 2018, by St. Cloud High School. The Notice of Petition for Waiver or Variance was published in Vol. 44, No. 116, of the May 30, 2018, Florida Administrative Register. Petitioner sought a variance or waiver from subsection 64B9-15.005(6), F.A.C., regarding the program’s passing rate required by the rule. The Board considered the instant Petition at a duly-noticed public meeting held on August 1-3, 2018, in Ft. Lauderdale, Florida. The Board’s Order, filed on September 17, 2018, voted to deny the petition for variance or waiver, finding that Petitioner failed to demonstrate a substantial hardship; failed to demonstrate that application of the rule would violate the principle of fairness; and failed to demonstrate that the purpose of the underlying statute has been met.
