NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Charles D. Johnson, Esq., In Re: Hawthorne Residents Cooperative Association, Inc., Docket No. 2018043248, filed on August 16, 2018. The petition seeks the agency's opinion as to the applicability of paragraph 719.106(1)(i), Florida Statutes, as it applies to the petitioner.

May the members of the Association, by their affirmative vote, amend the governing documents of the Association to allow a capital contribution fee (transfer fee) in excess of the $100 fee permitted by paragraph 719.106(1)(i), Florida Statutes, on an arms-length transfer of a unit for the approval of a unit sale?
