NOTICE IS HEREBY GIVEN that on August 23, 2013, the Division of Alcoholic Beverages and Tobacco, Department of Business and Professional Regulation, State of Florida, received a petition for Rule Waiver Request filed by ABC Liquors Store # 137, VW 2013-285.
Subsection No: 61A-1.006(3)
Nature of the rule for which variance or waiver is sought: The Petitioner, ABC Liquors Store # 137 requests a Rule Waiver of subsection 61A-1.006(3), pursuant to Section 120.542, under Florida Statues. Subsection No. 61A-1.006(3) defines, the term “package store” as a licensed place of business where alcoholic beverages are sold in the original sealed containers as received from the distributor for consumption off the premises only. The Petitioner expresses substantial hardship due to the requirement of increased licensing fees and expenses relating to upgrading to a COP license.
