NOTICE IS HEREBY GIVEN that the Department of Financial Services has issued an order disposing of the petition for declaratory statement filed by William Harrison, Fire Marshal, Clermont Fire Department on June 30, 2014. The following is a summary of the agency’s disposition of the petition:

The Notice of Petition for Declaratory Statement was published July 10, 2014, in Vol. 40, No. 133 of the Florida Administrative Register. The Petitioner sought a determination by the Department as to whether, under NFPA 25 inspections, is it the intent of NFPA 25:13.2.7.1 that riser pressures meet the base of the riser demand listed on the hydraulic calculation plate, if yes, and the water pressure is below the listed requirement, would this be considered impairment and if it is an impairment, should the system be red-tagged following the guidelines of Rule 69A-46.041, Florida Administrative Code. The Petition was answered in the affirmative that NFPA 25 inspections required the water pressure to meet the base riser demand as listed on the hydraulic calculation plate and if the riser pressure is lower than listed, the system should be red-tagged and/or included in the inspection report, pursuant to the guidelines of Rule 69A-46.041, Florida Administrative Code.
