    NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 42 No. 112, June 9, 2016 issue of the Florida Administrative Register.

    The changes are in response to comments submitted by the Joint Administrative Procedures Committee in a letter dated July 13, 2016.  The changes are as follows:

    62-505.300 General Program Information.

    (1) No change.

    (2) Steps involved in obtaining a Small Community Wastewater Facility Grant:

    (a) through (e) No change.

    (f) Grant Application and Agreement.

    1. To receive a grant, a project sponsor must demonstrate that it has the financial capability to complete the project, and that it has the ability to repay the SRF loan. The amount of the grant and the terms of the SRF loan repayment shall be incorporated into the project sponsor’s SRF loan agreement.

    2. A complete State Revolving Fund (SRF) loan application, as provided for under paragraph 62-503.430(1)(a), shall be submitted to the Department within 120 days, and an SRF loan agreement shall be executed within 210 days, after the project has been identified as eligible for funding at a priority list public meeting.

    3. The failure to submit a State Revolving Fund (SRF) loan application or execute an SRF loan agreement within the timeframes listed in paragraphs 62-503.430(1)(a) and (c), F.A.C. subparagraph 2. above, will result in the project being removed from the priority list. After removal, the project sponsor must successfully compete for funding at a subsequent priority list public meeting in order to retain the grant funding.
