    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by Andrew P. Speranzini, Esq., In Re: Toscana West Condominium Association, Inc., Docket No. 2016023215, on May 11, 2016. The following is a summary of the agencys declination of the petition:

    The Division declined to issue a Declaratory Statement because it does not have authority to interpret, and then enforce its interpretation of, the provisions of a condominium declaration that are ambiguous; and because it does not have authority to determine questions of fact in a declaratory statement. The order was filed with the Agency Clerk on August 1, 2016.
