    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Erik F. Whynot, Esq., Alan B. Garfinkel, Esq., Dara L. Lahav, Esq., In Re: Dory Villas on Lake Miona Condominium Association, Inc., Docket No. 2016040522, filed on August 26, 2016.The petition seeks the agencys opinion as to the applicability of Florida Statute §718.112(2)(l) as it applies to the petitioner.

    Does Florida Statute §718.112(2)(l) apply to all residential condominium associations in Florida, regardless of building or residence height? Must all residential condominiums in Florida, regardless of height, file a Retrofitting Report with the DBPR by December 31, 2016? If a residential condominium in Florida, regardless of height, is not in compliance with the requirements for a fire sprinkler system, and has not voted to forego retrofitting such system before December 31, 2016, must it initiate an application for a building permit for the required installation with the local government having jurisdiction demonstrating that the association will become compliant by December 31, 2019?
