PURPOSE AND EFFECT: The Department intends to amend Rule 65A-1.716, F.A.C., Income and Resource Criteria. The rule is amended annually or when there is a change in the figures used in the Medicaid eligibility determination process.
SUMMARY: The amendments accomplish the following: 1) Updates the federal poverty levels (FPL), 2) Adds income and asset limits for the Working People with Disabilities (WPwD) program, and 3) Updates life expectancy tables.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Department used a checklist to conduct an economic analysis and determine if there is an adverse impact or regulatory costs associated with this rule that exceeds the criteria in section 120.541(2)(a), F.S. Based upon this analysis, the Department has determined that the proposed rule is not expected to require legislative ratification.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

(4) The maximum resource limit is $2,000 for those individuals receiving Temporary Cash Assistance (TCA):
(a) No change.
(b) Children Are children living with their parent(s) and who, as children, would qualify for cash assistance except for their age. The maximum resource limit of $2,000 also applies to those coverage groups indicated in Rule 65A-1.703, F.A.C. However, there is no asset limit for the coverage groups specified in paragraphs 65A-1.703(3) through (5), F.A.C.
(5) The SSI-Related Medicaid Program Standards:
(a) No change.
(b) The income limit which applies to an individual in Home and Community-Based Services (HCBS) Waivers waiver programs, Institutional Care Programs (ICP), and Hhospice is 300 percent of the Federal Benefit Rate (FBR) for individuals an individual. For an individual enrolled in HCBS Working People with Disabilites (WPwD) who is employed and age 21 years or older, the financial standards are:
1. Income limit of 550 percent of the FBR, $4,367 for an eligible individual or $8,734 for an eligible couple
2. Asset limit of $13,000 for an eligible individual or $24,000 for an eligible couple
(c) No change.
(d) The average monthly private pay nursing facility rate is $9,703 $9,485.
(e) The average monthly Medicaid rate is $7,224.
(f)(e) The following life expectancy tables are compiled from information published by the Office of the Chief Actuary of the Social Security Administration:
