The Board of Nursing Home Administrators hereby gives notice: that on August 3, 2018, an Order was filed on the Petition for Variance or Waiver. The Petition for Variance or Waiver was filed by Michael Buxton, on June 27, 2018, seeking a waiver or variance of subsection 64B10-16.003(3), F.A.C., which requires a nursing home facility at which training takes place to have a minimum capacity of 60 beds. The Notice of Petition for Variance or Waiver was published in Volume 44, No. 129, of the July 3, 2018 issue of the Florida Administrative Register. No comments were received on the Petition. The Board, at its meeting held on July 23, 2018, voted to deny the Petition for Variance or Waiver finding that the Petitioner’s Petition did not meet the criteria either in format or substance pursuant to Section 120.542, Florida Statutes, and Rule 28-104.002, F.A.C.
