    NOTICE IS HEREBY GIVEN that The Department of Business and Professional Regulation, Division of Alcoholic Beverages and Tobacco has declined to rule on the petition for declaratory statement filed by Robert Rinke, on behalf of Pensacola Beach Boardwalk (DS 2015-060) on May 13, 2015. The following is a summary of the agencys declination of the petition:

    The Petitioner, Robert Rinke, sought a Declaratory Statement concerning the specialty center status of the Pensacola Beach Boardwalk and whether that status could be revoked. The Petitioner failed to specify sufficient facts necessary for the Division to determine whether the Pensacola Beach Boardwalk meets the criteria to be designated as a specialty center. In addition, Section 561.20, Florida Statutes, describes no mechanism by which an already established specialty center may have that designation revoked.
