NOTICE IS HEREBY GIVEN that Department of Financial Services, Division of State Fire Marshal has received the petition for declaratory statement from Old Port Cove Condominium Five Association, Inc. The petition seeks the agency’s opinion as to the applicability of subsection 633.208(5), Florida Statute, and NFPA 101:31.2.11.1 as it applies to the petitioner.

Petitioner is asking for a determination in an Amended Petition for Declaratory Statement as to whether: 1) the Fire Safety Evaluation System for Board and Care Facilities using prompt evacuation capabilities parameter values found in NFPA 101A provide a method for determining equivalent compliance for all the requirements of NFPA 101: chapter 31, only the engineered life safety system, or all the requirements in NFPA 101: Chapter 31 except for the engineered life safety system; and 2) smoke proof enclosures are required for Marina Tower.
