PURPOSE AND EFFECT: The purpose of the amendment to Rule 34-7.010 is to add a new form to be used to certify a public officer's qualified blind trust – CE Form 40, and to amend the voting conflict forms – CE Form 8A and CE Form 8B – to reflect changes in the process for declaring voting conflicts for both state and local officers as a result of the enactment of Chapter 2013-36, L.O.F.
SUMMARY: CE Form 8A (Memorandum of Voting Conflict for State Officers), CE Form 8B (Memorandum of Voting Conflict for County, Municipal, and Other Local Officers, and a new form – CE Form 40 (Certification by Trustee of Qualified Blind Trust), are affected by this rulemaking.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The filing of the referenced forms only affects public officials, not small businesses. There is no discernable impact on small businesses.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

(1) The following forms and instructions are adopted by reference and are used by the Commission in its dealings with the public:

(e) Form 8A, Memorandum of Voting Conflict for State Officers. To be utilized by public officers serving at the State level of government for compliance with Section 112.3143, F.S. Effective _______ 1/2000.
(f) Form 8B, Memorandum of Voting Conflict for County, Municipal, and Other Local Public Officers. To be utilized by public officers serving at local levels of government for compliance with Section 112.3143, F.S. Effective _______ 1/2000.
