NOTICE IS HEREBY GIVEN that Department of Education has declined to rule on the petition for declaratory statement filed by Rod Hartsook, the Martin County Education Association, and the Florida Education Association on May 08, 2017. The following is a summary of the agency’s declination of the petition:
The petition seeks the agency's opinion as to the applicability of section 1012.22(1)(c), Florida Statutes, requiring that district school boards adopt a performance salary schedule for instructional personnel, to JROTC instructors employed as instructional personnel by the Martin County School Board and/or other district school boards in Florida. The department does not have authority concerning salaries of personnel, as 1012.27(2), Fla. Stat., provides that the district school superintendent is responsible for preparation and recommendation of salary schedules in accordance with § 1012.22, Fla. Stat., to the district school board for adoption. Further, to the extent there may be a collective bargaining agreement governing these issues in Martin County, this matter is more appropriately resolved through the bargaining process and not through administrative channels. The final order was issued August 7, 2017.
