SUMMARY: This emergency rule describes the GameDay Cash Promotion that will be conducted between September 1, 2017, and November 27, 2017, in which cash, a 2018 Winnebago RV Motorhome and college football prizes will be awarded.

THE FULL TEXT OF THE EMERGENCY RULE IS:

53ER17-53 GameDay Cash Promotion.

(1) Beginning September 1, 2017, through November 27, 2017, (“Promotion Period”) the Florida Lottery will conduct the GameDay Cash Promotion (“Promotion”). Players who purchase a FLORIDA LOTTO®, FLORIDA LOTTO® with XTRA, FANTASY 5®, FANTASY 5® with EZmatch or CORNHOLE CASH™ Fast Play ticket of any price point (“qualifying game ticket’) at a Florida Lottery (“Lottery”) retailer location can collect symbols to earn entries in one or more team drawings in one of five participating college team “Fan Experiences” for a chance to win cash and college football prizes. The team experiences are: the Canes® Fan Experience; the Gators® Fan Experience; the Seminoles® Fan Experience; the Bulls™ Fan Experience; and the Knights™ Fan Experience. Additionally, players can collect symbols to earn entries into the RV Grand Prize drawing for a chance to win the Grand Prize of a 2018 Winnebago RV Motorhome provided by Lazydays RV (“Lazydays”). Both winning and non-winning qualifying game tickets purchased during the Promotion Period may be used to enter the Promotion including FLORIDA LOTTO tickets associated with Jackpot Combo, and FLORIDA LOTTO and FANTASY 5 tickets associated with GROUPER®.

(2) How to Participate.

(a) GameDay Cash Promotion App Download. A player may participate in the Promotion by downloading the free GameDay Cash Promotion app at the iTunes® Store or at Google Play® to his or her smartphone or tablet.

(b) Web Browser. A player may also participate in the Promotion via web browser by visiting the Florida Lottery’s homepage, flalottery.com, clicking on the GameDay Cash Promotion banner and following the directions, or by going directly to flalottery.com/gamedaycash. Players can also access the Lottery’s website to enter a ticket number via a link located on each of the following five colleges’ athletics websites:

(c) Players must register their contact information one time upon first usage. A player will be sent an email directing the player to confirm his or her registration. The player should check his or her junk mail or spam folder if the player does not promptly receive an email confirmation. Thereafter, the player may directly login by entering his or her email address and password or may login through the player’s Facebook or Twitter account. Upon initial registration, the player will be prompted to select his or her favorite college team. Thereafter, the player will be able to change the team selection from the menu to allow the player to enter tickets into another team drawing, if desired.

(d) Regardless of whether a player chooses to participate in the Promotion by smartphone, tablet or web browser the following provisions shall apply:

1. The player may use the same account login information to enter tickets;

2. The player will only be required to register one time; and

3. The player’s entry history will be cumulative among the entry platforms.

(3) How to Earn Entries.

To collect play symbols and earn entries into a drawing, a player may scan the barcode on the bottom of a ticket using a camera on a smartphone or tablet, or a player may manually enter the 19-digit ticket number (located near the bottom of the ticket) on the entry page at flalottery.com/gamedaycash. Four game cards will appear on the screen. Each game card contains four spots to collect four symbols. Each FANTASY 5, FANTASY 5 with EZmatch, FLORIDA LOTTO or FLORIDA LOTTO with XTRA ticket number entered will randomly generate a quantity (2, 4, 6, 8, or 10) of the four play symbols and place them in an available game card. Each CORNHOLE CASH ticket number entered will randomly generate a quantity (6, 8, or 10) of the four play symbols and place them in an available game card. Once a symbol has been collected on all four play cards, the symbol will be eliminated from the random selection process. When a single game card is filled up with all four different symbols, an entry is generated into one or more drawings in accordance with subsection (5) and the game card will reset to capture more symbols towards the next entry. Partially completed cards will carry over to the next entry period. A player may earn multiple entries during the contest period; however, a player may only manually enter or scan up to two hundred tickets per day. Each ticket number can only be scanned or entered one time, for one entry into one or more drawings in accordance with subsection (5). Entries that include training tickets that were produced by a retailer terminal while in training mode or tickets with invalid ticket numbers will be disqualified from the applicable drawing or drawings. The odds of winning depend on the number of entries in each drawing. All entries are subject to validation by the Florida Lottery and may be disqualified if eligibility requirements are not met. Entries associated with a canceled ticket(s) will be ineligible to win a prize in a drawing(s). CORNHOLE CASH and FANTASY 5 with EZmatch tickets cannot be canceled. Qualifying game tickets should not be mailed to the Lottery for entry into the Promotion. Such tickets received in the mail by the Florida Lottery will not be entered into the Promotion and will not be returned.

(4) Coupons.

During the Promotion Period, coupons will be generated for every “nth” ticket scanned or entered statewide up to a maximum of 44,000 coupons. When an nth ticket is generated, it will activate a bonus game in which the player can “skip” or choose to play and “kick a field goal.” Regardless of whether or not the player plays the bonus game, a message will appear on the player’s coupons page and notify the player that a coupon has been added to the player’s account. To redeem, the player must print the coupon and present it to any Florida Lottery retailer or a Florida Lottery office. Coupons may not be redeemed by mail. Coupons are valid for one use only and expire at midnight ET on December 31, 2017. The odds of winning a coupon depend on the number of tickets entered per day. The coupons offered are as follows:

(a) $25 Cash Prize;

(b) Get a free $1 FLORIDA LOTTO® Quick Pick ticket;

(d) Buy a $2 CORNHOLE CASH™ ticket; get a free $1 FLORIDA LOTTO® Quick Pick ticket;

(e) Buy a $2 CORNHOLE CASH™ ticket; get a free $1 FANTASY 5® Quick Pick ticket.

(5) Drawings and Number of Prizes.

(a) Team Fan Experience Drawings. In each of the five team experiences, four Fan Experience Drawings will be conducted by the Florida Lottery using a certified random number generation process. The team Fan Experience Drawings will be held on September 19, 2017, October 3, 2017, October 17, 2017, and October 31, 2017, and will include entries submitted and received during the corresponding entry period. In each drawing, the Florida Lottery will draw a total of seventy-one entries. The first valid entry drawn will win a first prize. The second through eleventh valid entries drawn will each win a second prize. The twelfth through fifty-first valid entries drawn will each win a third prize. The remaining valid entries drawn will be used as alternates in the order in which they were drawn and in the order of need to select a prizewinner in the event a first or second prize cannot be awarded. Alternates entries will not be used for third prizes. A total of fifty-one prizes will be available in each team Fan Experience Drawing. Alternate entries in a team Fan Experience Drawing that have not been used to award a Fan Experience prize as of November 27, 2017, will be included in the team Grand Prize Drawing and the RV Grand Prize Drawing.

(b) RV Grand Prize Drawing. The RV Grand Prize Drawing will be held on November 28, 2017, and will include all entries in all five team experiences submitted and received between September 1, 2017, and November 27, 2017, except entries that were selected as winners in the Fan Experience Drawings. In the RV Grand Prize Drawing, the Florida Lottery will draw a total of five entries. The first valid entry will win the RV grand prize. The remaining valid entries will be used as alternates in the order in which they were drawn to select a prizewinner in the event the RV grand prize cannot be awarded. One prize will be available in the RV Grand Prize Drawing. Alternate entries selected in the RV Grand Prize Drawing will also be included in the applicable Team’s Grand Prize Drawing.

(c) Team Grand Prize Drawings. In each of the five team experiences, one team Grand Prize Drawing will be conducted by the Florida Lottery using a certified random number generation process. The five team Grand Prize Drawings will be held on November 28, 2017, after the RV Grand Prize Drawing. Each team’s Grand Prize Drawing will include all entries submitted and received between September 1, 2017, and November 27, 2017, except entries that were selected as winners in the team’s Fan Experience Drawings. In each team’s Grand Prize Drawing, the Florida Lottery will draw a total of fifteen entries. The first valid entry drawn will win the first prize. The second valid entry drawn will win the second prize. The third valid entry drawn will win the third prize. The fourth valid entry drawn will win the fourth prize. The fifth valid entry drawn will win the fifth prize. The sixth valid entry drawn will win the sixth prize. The remaining valid entries drawn will be used as alternates in the order in which they were drawn and in the order of need to select a first, second, third, fourth, fifth or sixth prizewinner in the event a prize cannot be awarded. A total of six prizes will be available in each team’s Grand Prize Drawing.

(d) A player may win more than one time in a drawing and may win in more than one drawing with more than one entry; however, a single entry is not eligible for more than one prize in the Promotion.

(6) Winner Notification. The prizewinners in each team’s four Fan Experience Drawings, each team’s Grand Prize Drawing and the RV Grand Prize Drawing will be posted on flalottery.com approximately three days after the drawings. The Florida Lottery will attempt to notify each winner by telephone or email (personal contact), using the contact information provided in the winner’s registration data, beginning on the first business day after the winners are posted on the Florida Lottery’s website. The Florida Lottery deems the winner’s registration data as the winner’s official contact information, including the physical mailing address, and will not attempt to further locate a winner if attempts to reach the winner using the winner’s registration data are unsuccessful.

(a) Fan Experience Drawings.

1. First Prize winners: For all Fan Experience Drawings, if the Florida Lottery is unable to have personal contact with a first prize winner within two weeks of the date of the drawing, the winner will forfeit his or her right to claim the prize and the prize will be awarded to an alternate winner in accordance with subsection (5)(a) above. If the Florida Lottery is unable to have personal contact with the alternate winner within two weeks of the date of notification, the alternate winner will forfeit his or her right to claim the prize, and the prize will be awarded to the next eligible alternate winner. This process will continue until an alternate is contacted and the prize is claimed in accordance with subsection (13) below, or the Florida Lottery has exhausted the list of available alternates. If the Florida Lottery is unable to contact an alternate, the prize will not be awarded.

2. Second Prize winners:

a. For the September 19, 2017, October 3, 2017, and October 17, 2017, Fan Experience Drawings, the notification period shall extend four business days from the date of the drawing. If the Florida Lottery is unable to have personal contact with a second prize winner within four business days, the winner will forfeit his or her right to claim the prize and the prize will be awarded to the first alternate winner in accordance with subsection (5)(a) above. If the Florida Lottery is unable to have personal contact with the first alternate winner within four business days of the date of notification, the alternate winner will forfeit his or her right to claim the prize and the prize will be awarded to the second alternate winner in accordance with subsection (5)(a) above. If the Florida Lottery is unable to have personal contact with the second alternate winner within four business days of the date of notification, the alternate winner will forfeit his or her right to claim the prize and no further alternate attempts will be made. If after two attempts the Lottery is unable to contact an alternate, the prize will not be awarded.

b. For the October 31, 2017, Fan Experience Drawing, the notification period shall extend two business days from the date of the drawing. If the Florida Lottery is unable to have personal contact with a second prize winner within two business days, the winner will forfeit his or her right to claim the prize and the prize will be awarded to the first alternate winner in accordance with subsection (5)(a) above. If the Florida Lottery is unable to have personal contact with the first alternate winner within two business days of the date of notification, the alternate winner will forfeit his or her right to claim the prize and the prize will be awarded to the second alternate winner in accordance with subsection (5)(a) above. If the Florida Lottery is unable to have personal contact with the second alternate winner within two business days of the date of notification, the alternate winner will forfeit his or her right to claim the prize and no further alternate attempts will be made. If after two attempts the Lottery is unable to contact an alternate, the prize will not be awarded.

3. Third Prize winners: For all Fan Experience Drawings, if the Florida Lottery is unable to have personal contact with a third prize winner within two weeks of the date of the drawing, the winner will forfeit his or her right to claim the prize and the prize will not be awarded. Alternate entries will not be drawn for third prize winners.

(b) RV Grand Prize Drawing. If the Florida Lottery is unable to have personal contact with the Grand Prize winner in the RV Grand Prize Drawing within one week of the date of the drawing, the winner will forfeit his or her right to claim the prize and the prize will be awarded to the first eligible alternate winner in accordance with subsection (5)(b) above. If the Florida Lottery is unable to have personal contact with the alternate winner within one week of the date of notification, the alternate winner will forfeit his or her right to claim the prize, and the prize will be awarded to the next eligible alternate winner. This process will continue until an alternate is contacted and the prize is claimed in accordance with subsection (13) below, or the Florida Lottery has exhausted the list of available alternates. If the Lottery is unable to contact an alternate, the prize will not be awarded.

1. First, Second, Fourth, Fifth and Sixth Prize winners: If the Florida Lottery is unable to have personal contact with the first, second, fourth, fifth or sixth prize winner in the Team Grand Prize Drawing within two weeks of the date of the drawing, the winner will forfeit his or her right to claim the prize and the prize will be awarded to the first eligible alternate winner in accordance with subsection (5)(c) above. If the Florida Lottery is unable to have personal contact with the alternate winner within two weeks of the date of notification, the alternate winner will forfeit his or her right to claim the prize, and the prize will be awarded to the next eligible alternate winner. This process will continue until an alternate is contacted and the prize is claimed in accordance with subsection (13) below, or the Florida Lottery has exhausted the list of available alternates. If the Lottery is unable to contact an alternate, the prize will not be awarded.

2. Third Prize winners: If the Florida Lottery is unable to have personal contact with a third prize winner within three business days of the date of the drawing, the winner will forfeit his or her right to claim the prize, and the prize will be awarded to the first eligible alternate winner in accordance with subsection (5)(c) above. (7) Canes Fan Experience Prizes.

(a) Fan Experience Prizes.

1. First Prize: Two season tickets for the 2018 UM regular football season, two UM hats, two UM t-shirts and $50 in Lottery Scratch-Off tickets. (Total value $806)

2. Second Prize: Two tickets to the UM vs. University of Virginia game on November 18, 2017, two pre-game hospitality passes, two UM hats, two UM t-shirts and $40 in Lottery Scratch-Off tickets. If a second prize awarded in the October 31, 2017, drawing is not claimed in time for the winner to use the November 18, 2017, the game tickets and pre-game hospitality passes will be for the first UM home game during the regular 2018 season. (Total value $246)

3. Third Prize: Two UM hats, two UM t-shirts and $20 in Lottery Scratch-Off tickets. (Total value $76)

(b) Grand Prize Drawing Prizes.

1. First Prize: $20,000 in cash, two UM polo shirts, two UM hats, and $220 in Lottery Scratch-Off tickets. The Florida Lottery will withhold applicable federal income tax withholding on the total value of the prize from the $20,000 cash portion of the prize. The total value of the prize is $20,322.

2. Second Prize: RV Getaway includes a 5 Day Class C Motorhome Rental provided by Lazydays, $1,500 in cash, a $250 Lazydays RV Accessories & More gift certificate, $170 rental insurance fee coverage and $180 in Lottery Scratch-Off tickets. (Total value $4,100)

3. Third Prize: $2,000 in cash, two tickets to the UM bowl game at the conclusion of the 2017 season*, two UM hats, two UM polo shirts and $160 in Lottery Scratch-Off tickets. (Total value $2,662)

4. Fourth Prize: $1,500 in cash, two tickets to a UM away game (to be determined by UM) during the 2018 regular season, two UM hats, two UM polo shirts and $160 in Lottery Scratch-Off tickets. (Total value $1,962)

If a second prize awarded in the October 31, 2017, drawing is not claimed in time for the winner to use the November 18, 2017, the game tickets and pre-game hospitality passes will be for the first UF home game during the regular 2018 season. 3. Third Prize: Two UF hats, two UF t-shirts and $20 in Lottery Scratch-Off tickets. (Total value $76)

(b) Grand Prize Team Drawing Prizes.

1. First Prize: $20,000 cash, two UF polo shirts, two UF hats, and $220 in Lottery Scratch-Off tickets. The Florida Lottery will withhold applicable federal income tax withholding on the total value of the prize from the $20,000 cash portion of the prize. The total value of the prize is $20,322.

(10) Bulls Fan Experience Prizes.

1. First Prize: Two season tickets for the 2018 USF regular football season, two USF hats, two USF t-shirts and $50 in Lottery Scratch-Off tickets. (Total value $736)

2. Second Prize: Two tickets to the USF vs. Tulsa game on November 16, 2017, two pre-game hospitality passes, two USF hats, two USF t-shirts and $40 in Lottery Scratch-Off tickets. (12) RV Grand Prize: New 2018 Winnebago Minnie Winnie Class C RV Motorhome provided by Lazydays (Model 26A). The Florida Lottery will pay applicable federal income tax withholding on the retail value of the RV Grand Prize. The retail value of the RV grand prize is estimated at $116,890.09 ($107,687 MSRP, plus sales tax, tag, title, and delivery and inspection fees). Federal income tax withholding is estimated at $38,963.36. The reportable taxable value of the RV grand prize is estimated at $155,853.45. Any taxes on the prize in excess of applicable federal income tax withholding requirements are the sole responsibility of the prizewinner.

(13) How to Claim a Prize.

(a) A first prize winner in a team Fan Experience Drawing; all prizewinners, except sixth prize winners, in a team Grand Prize Drawing; and the RV grand prize winner in the RV Grand Prize Drawing must submit a completed Winner Claim Form DOL-173-2, revised 09/13, or DOL-173-2S, revised 09/13 (Spanish version of the Winner Claim Form) and a copy of acceptable identification as set forth in the rule of the Florida Lottery governing payment of prizes. A copy of the current prize payment rule can be obtained from the Florida Lottery, Office of the General Counsel, 250 Marriott Drive, Tallahassee, Florida 32399-4011. First and second prize winners in a team Fan Experience Drawing, all prizewinners in a team Grand Prize Drawing, except the first prize winner, and the RV grand prize winner in the RV Grand Prize Drawing must also submit a completed Release and Authorization form DOL-474, effective 8/13, or Spanish Release and Authorization form DOL-474S, effective 8/13. A third prizewinner in a team Fan Experience Drawing and the sixth prizewinner in a team Grand Prize Drawing must submit a copy of acceptable identification. The required claim documents and timeframe to return the documentation for each prize level are set forth in the following table.

(b) A winner who does not submit the required documentation to the Lottery for receipt by the Lottery within the applicable timeframe set forth above, will forfeit his or her right to claim the prize and the prize will be awarded to an alternate winner in accordance with the alternate provisions set forth in this rule. The same claim timeframes set forth for the original winner of a prize shall apply to an alternate winner.

(c) Forms DOL-173-2, DOL-173-2S, DOL-474, and DOL-474S are hereby incorporated by reference and can be obtained from any Lottery office, or by writing to: Florida Lottery, Customer Service Division, 250 Marriott Drive, Tallahassee, Florida 32399-4016. Forms DOL-173-2 and DOL-173-2S can also be obtained from the Lottery’s website, flalottery.com.

(14) Award of Prizes.

(a) Team Fan Experience Drawing Prizes.

1. First Prize: Upon the Florida Lottery’s timely receipt of a first prize winner’s required documentation, the Florida Lottery will ship the winner the team hats, t-shirts, Lottery Scratch-Off tickets* and a certificate with the necessary information to obtain the team football tickets from the fulfillment entity.

2. Second Prize. Upon the Florida Lottery’s timely receipt of a second prize winner’s required documentation, the Florida Lottery will ship the winner the team hats, t-shirts, Lottery Scratch-Off tickets* and a certificate with the necessary information to obtain the team football tickets and pre-game hospitality passes from the fulfillment entity.

3. Third Prize. Upon the Florida Lottery’s timely receipt of a third prize winner’s required documentation, the Florida Lottery will ship the winner the team hats, t-shirts and Lottery Scratch-Off tickets*.

(b) Team Grand Prize Drawing Prizes.

1. First Prize. Upon the Florida Lottery’s timely receipt of a first prize winner’s required documentation, the Florida Lottery will award a cash prize of $20,000, less applicable federal tax withholding on the value of the entire prize. The Florida Lottery will ship the winner the Lottery Scratch-Off tickets* and the team hats and polo shirts.

2. Second Prize. Upon the Florida Lottery’s timely receipt of a second prize winner’s required documentation, the Florida Lottery will award a cash prize of $1,500. The Lottery will ship the prizewinner the Lottery Scratch-Off tickets*. The Lottery will provide the prizewinner a certificate describing the RV rental, insurance and gift certificate and provide Lazydays contact person information. RV Rentals must be booked by March 31, 2018, redeemed by May 25, 2018, and are subject to availability. The LazyDays RV Accessories & More gift certificate will be provided to the prizewinner at the time of the RV rental fulfillment. The prizewinner must travel to the Lazydays dealership in Seffner, Florida for pickup and return of the vehicle. A $1,000 security deposit in the form of credit, debit, cash, money order or cashier’s check is required from the prizewinner prior to picking up the RV rental. The security deposit is refundable all or in part depending on damage, excessive wear and tear or if the RV requires unusual cleaning after rental. The prizewinner must present a valid driver’s license and be 25 years of age or older. If the prizewinner is not 25 years of age or older, a person accompanying the prizewinner who is 25 years of age or older and presents a valid driver’s license may rent the RV in the prizewinner’s stead. The RV rental includes unlimited mileage; however, the winner shall be responsible for all fuel expenses. Cancelation or rebooking of a reservation must be completed at least thirty days prior to the reservation pick-up date for no penalty fees to be assessed. Any cancelation or rebooking fees assessed shall be the sole responsibility of the prizewinner.

3. Third Prize. Upon the Florida Lottery’s timely receipt of a third prize winner’s required documentation, the Lottery will award a cash prize of $2,000. The Florida Lottery will ship the winner the Lottery Scratch-Off tickets*, and the team hats and polo shirts. The winner will also be provided a certificate with the necessary information to obtain the bowl game tickets from the fulfillment entity.

4. Fourth Prize. Upon the Florida Lottery’s timely receipt of a fourth prize winner’s required documentation, the Lottery will award a cash prize of $1,500. The Florida Lottery will ship the winner the Lottery Scratch-Off tickets* and the team hats and polo shirts. The winner will also be provided a certificate with the necessary information to obtain the team football tickets from the fulfillment entity.

5. Fifth Prize. Upon the Florida Lottery’s timely receipt of a fifth prize winner’s required documentation, the Florida Lottery will ship Lottery Scratch-Off tickets* and the team hats and polo shirts. The winner will also be provided a certificate with the necessary information to obtain the team football tickets from the fulfillment entity.

6. Sixth Prize. Upon the Florida Lottery’s timely receipt of a sixth prize winner’s required documentation, the Florida Lottery will ship the winner the Lottery Scratch-Off tickets* and the team hats and polo shirts. The winner will also be provided a certificate with the necessary information to obtain the team football tickets from the fulfillment entity.

* A winner whose mailing address is outside the state of Florida will receive a check for the value of the Lottery Scratch-Off tickets portion of the prize in lieu of the actual tickets.

1. Upon the Florida Lottery’s timely receipt of the RV grand prize winner’s required documentation, the Florida Lottery will award a new 2018 Winnebago Minnie Winnie Class C RV Motorhome (Model 26A). The Florida Lottery will provide the winner a certificate describing the prize and the Lazydays dealership contact information. The Florida Lottery will provide the prizewinner’s contact information to the dealership which, in turn, will contact the winner within thirty days of notification. The prizewinner must travel to Lazydays RV in Seffner, Florida to accept delivery of the motorhome. The prizewinner must present proof of a valid driver’s license and proof of vehicle insurance as required by Chapters 322 and 320, Florida Statutes, respectively. If the winner is unable to provide proof of a valid driver’s license, the vehicle must be removed by trailer or similar transport equipment provided by the prizewinner or driven by a person who is able to provide proof of a valid driver’s license. The prizewinner must take possession of the vehicle within thirty days of receipt of notification that it is ready for pick up. If the prizewinner fails to take possession of the vehicle within thirty days of pickup notification, unless prior alternate arrangements have been made, the vehicle prize will be forfeited and no cash prize will be substituted. The cost of travel to take possession of a vehicle prize shall be the responsibility of the prizewinner.

2. The Florida Lottery and Lazydays provide no warranty for the 2018 Winnebago Minnie Winnie RV Motorhome. Any warranties and guarantees are those of the manufacturer only.

3. The winner of the 2018 Winnebago Minnie Winnie Class C RV Motorhome must be 18 years of age or older.

4. A cash option is not available in lieu of the vehicle. However, the Florida Lottery reserves the right to award a cash prize of $116,890.09 ($107,687 MSRP, plus sales tax, tag, title, and delivery and inspection fees) in lieu of a vehicle if, for reasons beyond the control of the Lottery, a vehicle is not available for award to a player. Federal income tax withholding will be deducted from a cash prize awarded under this provision. Any additional federal, state and/or local taxes or other fees are the responsibility of the winner.

(15) Taxes.

(a) Except as specifically described herein, all federal, state and/or local taxes or other fees on GameDay Cash Promotion prizes will be the responsibility of the winner.

(b) Federal income taxes are required to be withheld from a prize awarded to a nonresident alien claimant at the rate of thirty percent (30%) pursuant to applicable provisions of the Internal Revenue Code. For all prizes, a nonresident alien claimant will be required to pay the federal income withholding tax on the total value of the prize or forfeit the prize, except as follows. If the prize contains cash and non-cash elements, thirty percent (30%) federal income tax withholding will be withheld from the cash portion of the claimant’s prize. If the amount of federal income tax withholding exceeds the cash portion of the prize, the claimant will be required to pay the excess amount of taxes prior to receipt of the prize or forfeit the prize. The reporting and subsequent payment of any additional federal, state and/or local taxes shall be the responsibility of the nonresident alien winner.

(16) State Owed Debt.

If the first prize, second prize, third prize or fourth prize winner in a team Grand Prize Drawing is identified as owing an outstanding debt to a state agency or child support collected through a court, the debt will be collected in accordance with section 24.115, Florida Statutes. If the debt is an amount less than the cash portion of the prize, the non-cash portion of the prize and the cash portion of the prize less the amount owed and federal tax withholding, if applicable, shall be awarded. If the winner is identified as owing such a debt in an amount greater than the cash portion of the prize, the winner’s entire cash portion of the prize will be applied toward the outstanding debt as provided in section 24.115, Florida Statutes, and the winner will receive the remaining non-cash portion of the prize.

(17) Other Restrictions and Provisions.

(a) Except as otherwise specifically provided herein, no cash option is available in lieu of the non-cash prizes.

(b) The right to claim a prize cannot be assigned to another person or entity.

(c) All prizes are subject to the provisions of Chapter 24, Florida Statutes, and rules promulgated thereunder. Prizes will be paid in accordance with the rule of the Florida Lottery governing payment of prizes. Copies of the current prize payment rule can be obtained from the Florida Lottery, Office of the General Counsel, 250 Marriott Drive, Tallahassee, Florida 32399-4011.

(d) Players must be at least 18 years of age. Persons prohibited by Section 24.116, Florida Statutes, from purchasing a Florida Lottery ticket are not eligible to play.

(e) By entering the GameDay Cash Promotion, a player gives his or her permission for the Florida Lottery to provide the player’s address and telephone number to the fulfillment entity for prize fulfillment purposes.

(f) By entering the GameDay Cash Promotion, a player gives his or her permission for the Florida Lottery to photograph and/or videotape and record the prizewinner with or without prior notification and to use the name, photograph, videotape, and/or recording of the prizewinner for advertising or publicity purposes without additional compensation.

(g) The GameDay Cash Promotion drawings shall be public, held in Tallahassee, Florida, and witnessed by an accountant employed by an independent certified public accounting firm.
