NOTICE OF INTENT TO WITHDRAW ITN
AND
NOTICE OF INTENT TO PROCEED WITH NEGOTIATIONS PURSUANT TO SECTION 287.057(5), FLORIDA STATUTES
Having received less than two responsive replies, the Department states its intent to withdraw this ITN. This is the final posting by the Department on the DMS Vendor Bid System regarding this ITN.
The Department also states its intent to proceed with negotiations on the best terms and conditions pursuant to Section 287.057(5), Florida Statutes, in lieu of resoliciting competitive replies. The Department reserves the right to negotiate with any respondent to the above ITN, as well as any other person or organization of the Department’s choosing.
The negotiation process pursuant to Section 287.057(5), Florida Statutes, is an exceptional purchase as defined by Section 287.012(12), Florida Statutes, and is excepted from the requirements for competitive solicitation. However, the Department reserves the right to post appropriate notices on the DMS Vendor Bid System regarding any decisions arising from such exceptional purchase.
FAILURE TO FILE A PROTEST WITHIN THE TIME PRESCRIBED IN SECTION 120.57(3), FLORIDA STATUTES, OR FAILURE TO POST THE BOND OR OTHER SECURITY REQUIRED BY LAW WITHIN THE TIME ALLOWED FOR FILING A BOND SHALL CONSTITUTE A WAIVER OF PROCEEDINGS UNDER CHAPTER 120, FLORIDA STATUTES.
