    61G20-2.005Alternative Plans Review and Inspection forms Adopted

    PURPOSE AND EFFECT: Subsection 553.791(4), Florida Statutes, requires an individual utilizing a private provider to provide building code inspection services to notify the local building official on a form adopted by the Florida Building Commission. The Commission adopts this form (Form # 61G20-2.005-2002-01) via rule 61G20-2.005, F.A.C. Section 4, 2024-191 L.O.F. (HB 267 (2024)), made changes to the provisions pertaining to private providers, including allowing the fee owner’s contractor to furnish the form. The Commission intends to update Form # 61G20-2.005-2002-01 to reflect this change.

    SUMMARY: The proposed amendments will update Form # 61G20-2.005-2002-01 and make it consistent with the provisions of section 553.791, Florida Statutes.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The proposed amendments will merely amend a form to be consistent with new statutory provisions regarding who may submit the form.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
