    61J2-3.008Pre-licensing Education for Broker and Sales Associate Applicants

    The Florida Real Estate Commission hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed June 14, 2019, by Scott D. Sutherland. The Notice of Petition for Variance or Waiver was published in Vol. 45, No. 122, of the June 24, 2019, Florida Administrative Register. Petitioner sought a variance or waiver of subsection 61J2-3.008(1), F.A.C., that applicants for Florida licensure must take the 63 hour pre-licensure course and pass the Florida Real Estate Exam. The Commission considered the Petition at a duly-noticed public meeting held on July 17, 2019. The Commission’s Order, filed on August 21, 2019, denied the petition finding that Petitioner has not demonstrated that the purpose of the underlying statute would be achieved by other means, in that the Petitioner has not demonstrated compliance with Florida’s licensure requirements imposed by statute or rule.
