NOTICE IS HEREBY GIVEN that Department of Financial Services has issued an order disposing of the petition for declaratory statement filed by Winooski, LLC, DBA DealerPolicy Insurance Agency on June 13, 2019. The following is a summary of the agency's disposition of the petition:

The Petition requested a determination as to whether chapter 626, Florida Statutes, prohibits certain referral agreements (Agreements) between automobile dealers and licensed insurance producers. The Agreements provided that the dealers are not permitted to discuss insurance products and do not receive referral fees that are dependent on the actual binding of coverage of any insurance policies. The Department concludes that chapter 626, Florida Statutes, does not prohibit the proposed Agreements.
