Board of MedicineNOTICE IS HEREBY GIVEN THAT the Board of Medicine has issued a Final Order on the petition for declaratory statement filed on behalf of Paul J. Befanis, M.D., on May 3, 2007. The Notice of the Petition was published in Vol. 33, No. 20, of the May 18, 2007, F.A.W. The Board reviewed the Petition at its meeting held on June 2, 2007. The Board’s Final Order, filed in this matter on August 29, 2007, finds that participating in the “Patient Charity Program” as set forth in the Petition would be inducing or creating an incentive for patients to refer others to Petitioner’s practice. This constitutes prohibited rebates and/or kickbacks, precluded by Sections 456.054 and 458.331(1)(i), F.S.
