The Department of Children and Families hereby gives notice:
The Department has issued an order disposing of the petition for variance from subparagraph 65D-30.0142(1)(h)2., Florida Administrative Code, from Lakeview Center Medication Assisted Treatment (Century Clinic). Subparagraph 65D-30.0142(1)(h)2. requires all medication-assisted treatment providers to be open Monday through Saturday. Providers shall have medicating hours and counseling hours that accommodate individuals, including two (2) hours of medicating time accessible daily outside the hours of 9:00 a.m. - 5:00 p.m. The Notice of Variances and Waivers was published in Volume 49, No. 140 of the Florida Administrative Register on July 20, 2023.
The petition for variance was granted, subject to conditions, because Petitioner demonstrated a substantial hardship and that the underlying purpose of the statutes will be achieved.
