    PURPOSE AND EFFECT: The proposed rule development (OGC No. 10-0878) involves amendments to Chapter 62-212, F.A.C., to incorporate the effective elements of the U.S. Environmental Protection Agency’s December 31, 2002 “new source review reform” rule into the state’s nonattainment area preconstruction review program. The EPA requires the department to incorporate these concepts into the state rules, and it is to the benefit of the regulated industries in the pending nonattainment areas of the state for the department to have done so in advance of those areas being so designated. The proposed amendments clarify related topics and definitions, and for consistency with federal requirements, they also update references to particulate matter in the preconstruction review program from PM10 to PM2.5.
    SUBJECT AREA TO BE ADDRESSED: The proposed rule amendment involves the preconstruction review programs for attainment areas (prevention of significant deterioration) and for nonattainment areas.
