    The FLORIDA PUBLIC SERVICE COMMISSION announces a prehearing conference and an evidentiary hearing, which will include time set aside for public comment/testimony, in the following dockets to which all persons are invited.

    DOCKET NOS. AND TITLES: 20170235-EI - In re: Petition by Florida Power & Light Company (FPL) for authority to charge FPL rates to former City of Vero Beach customers and for approval of FPL's accounting treatment for City of Vero Beach transaction.  20170236-EU - In re: Joint petition to terminate territorial agreement, by Florida Power & Light and the City of Vero Beach.

    PREHEARING CONFERENCE DATE AND TIME:  Wednesday, October 3, 2018, 9:30 a.m.

    PLACE: Room 148, Betty Easley Conference Center, 4075 Esplanade Way, Tallahassee, Florida.

    GENERAL SUBJECT MATTER TO BE CONSIDERED AT THE PREHEARING:

    The purpose of this prehearing conference is to: (1) simplify the issues; (2) identify the positions of the parties on the issues; (3) consider the possibility of obtaining admissions of fact and of documents which will avoid unnecessary proof; (4) identify exhibits; (5) establish an order of witnesses; and (6) consider such other matters as may aid in the disposition of the action.

    HEARING DATE AND TIME:  Tuesday, October 9, 2018 at 9:00 a.m. Wednesday, October 10, 2018, has also been reserved for continuation of the hearing if needed. The starting time of the Wednesday session will be announced at the conclusion of the Tuesday session. The hearing may be adjourned early if all testimony is concluded.   “Public Testimony” will be taken beginning at 5:00 p.m. on Tuesday, October 9, 2018 (See below under the heading “TESTIMONY AND PARTY STATUS” for additional information).

    GENERAL SUBJECT MATTER TO BE CONSIDERED AT THE HEARING:

    The purpose of this hearing shall be to receive testimony and exhibits and to take final action relative to:  1. the petition by Florida Power & Light Company (FPL) for authority to charge FPL rates to former City of Vero Beach customers and for approval of FPL's accounting treatment for the City of Vero Beach transaction; 2. the joint petition to terminate territorial agreement, by Florida Power & Light and the City of Vero Beach; and 3. to take action on any motions or other matters that may be pending at the time of the hearing.  The Commission may rule on any such motions from the bench or may take the matters under advisement. This proceeding shall: (a) allow the parties to present evidence and testimony in support of their positions; (b) allow for such other purposes as the Commission may deem appropriate.

    TESTIMONY AND PARTY STATUS: Time has been set aside at 5:00 p.m., on Tuesday, October 9, 2018 for public comment/testimony. Any member of the public who wishes to offer public comment/testimony should be present at that time. By providing public comment/testimony, a person does not become a party to the proceeding.  Party status is determined in accordance with Rule 28-106.205, Florida Administrative Code. Any member of the public offering public comment/testimony and all witnesses testifying during the evidentiary hearing shall be subject to cross-examination at the conclusion of their testimony.  The hearing will be governed by the provisions of Chapter 120, Florida Statutes, and Chapters 25-22 and 28-106, Florida Administrative Code.
