64B5-16.002Required Training

The Board of Dentistry hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on April 5, 2018 by The Florida Dental Association. The Notice of Petition for Waiver or Variance was published in Volume 44, Number 70, of the April 10, 2018, Florida Administrative Register. The Petitioner was seeking a waiver or variance of paragraph 64B5-16.002(3)(b), Florida Administrative Code, entitled, “Required Training,” which requires that applicants provide documentation of the training and experience of faculty members which establishes their qualifications to teach specified subject areas. Applicants who have had a professional license revoked, suspended, or otherwise acted against, in Florida or in another jurisdiction, may be disqualified from participation as instructors.

The Board considered the instant Petition at a duly-noticed public meeting, held August 24, 2018, in Tampa, Florida. The Board’s Order, filed on September 14, 2018, granted the petition finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from paragraph 64B5-16.002(3)(b), F.A.C. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to its circumstances would violate principles of fairness and impose substantial hardship.
