The Board of Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling hereby gives notice: of the issuance of an Order Denying the Petition for Variance and Waiver, filed by Cindy Sichel on May 30, 2024. The Notice of Petition for Waiver or Variance was published in Vol. 50, No. 109, of the June 4, 2024, Florida Administrative Register. The Board considered the request at a duly-noticed public meeting held on August 8, 2024, in Naples, Florida. The Board found that the petitioner was in a substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code, The Board determined that the present petition is a request to waive a statutory provision, which is not within the jurisdiction of the Board to grant. Furthermore, the requirements for determining whether any licensing examination taken by the Applicant are located in Rule 64B4-3.0051, F.A.C., and the Applicant has failed to provide any of the require documentation for determination of same. The Board’s Order, filed on September 6, 2024, denied the petition from paragraph 64B4-3.003(2)(a), Florida Administrative Code.
