    11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

    NOTICE IS HEREBY GIVEN that on September 11, 2014, the Florida Department of Law Enforcement, Criminal Justice Standards and Training Commission, received a petition for a temporary waiver of paragraph 11B-27.002(4)(a), F.A.C., from Michael Dean Sutherland, II. The Petitioner wishes to waive for 180 days that portion of the rule that states within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that he began basic recruit training on October 18, 2010, and completed it in April 2011. Petitioner states that he has diligently and persistently attempted to gain employment at 15 different agencies. Petitioner states that for reasons other than his qualifications he has yet to become employed as a law enforcement officer. Petitioner states that he is currently in the hiring process with the Town of Palm Beach, Florida; that he has passed the oral, written and physical aspects of the hiring process and is currently awaiting a final decision. Petitioner states the Town of Palm Beach indicated an interest in hiring him. Petitioner also states that he is eligible to re-apply to the City of West Palm Beach, Florida and that city has also expressed an interest in hiring him.

    Petitioner states that strict application of the rule would result in unreasonable, unfair and unintended results in this instance. Petitioner states that he is currently employed as a finance manager with a motorsport dealership. Petitioner states that if he were forced to re-take basic recruit training he would have to give up his present job which would create an extreme economic hardship.

    Petitioner states that the purpose of Section 943.13, F.C. would be served if the waiver were granted.
