    FINAL ORDER

    APPROVING POLK COUNTY ORDINANCE NO. 19-046

    The Department of Economic Opportunity (“Department”) hereby issues its Final Order, pursuant to subsection 380.05(6), Florida Statutes, approving land development regulations adopted by Polk County, Florida, (the “County”) Ordinance No. 19-046 (the “Ordinance”).

    FINDINGS OF FACT

    1.                  The Green Swamp Area is designated by section 380.0551, Florida Statutes, as an area of critical state concern. The County is a local government within the Green Swamp Area of Critical State Concern.

    2.                  The Ordinance was adopted by the County on July 16, 2019, and rendered to the Department on July 26, 2019.

    3.                  The Ordinance amends provisions within the County’s Land Development Code relating to the North Ridge Selected Area Plan under Section 401.06.E.3.  The Ordinance modifies existing use limitations in Sections 401.06.3.e, 401.06.3.f, 401.06.3.i, 401.06.3.y, and 401.06.3.z, from 20 percent to 30 percent.  The Ordinance also amends certain acreage requirements in Sections 401.06.3.f and 401.06.3.i., and removes the 15 percent retail cap from the ECX district under Section 401.06.E.3.r.    

    CONCLUSIONS OF LAW

    4.                  The Department is required to approve or reject land development regulations that are adopted by any local government in an area of critical state concern.  See section 380.05(6), Florida Statutes; See also Chapter 28-26, Florida Administrative Code.

    5.                  “Land development regulations” include local zoning, subdivision, building, and other regulations controlling the development of land.  Section 380.031(8), Florida Statutes. The regulations adopted by the Ordinance are land development regulations. 

    6.                     The Ordinance is consistent with the County’s Comprehensive Plan generally, as required by section 163.3177(1), Florida Statutes, and specifically, Policy 2.131-Q4.

    7.                  All land development regulations enacted, amended, or rescinded within an area of critical state concern must also be consistent with the principles for guiding development for that area.   See section 380.05(6), Florida Statutes.  The Principles for Guiding Development for the Green Swamp Area of Critical State Concern are set forth in rule 28-26.003(1), Florida Administrative Code. 

    8.                  The Ordinance is consistent with the Principles for Guiding Development as a whole, and is not inconsistent with any of the Principles for Guiding Development.

    WHEREFORE, IT IS ORDERED that the Department finds that Polk County Ordinance No. 19-046 is consistent with the County’s Comprehensive Plan and the Principles for Guiding Development for the Green Swamp Area of Critical State Concern and is hereby APPROVED.
