The Board of Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling hereby gives notice: of the issuance of an Order Denying the Petition for Variance and Waiver, filed by Kaamilah Mixon on May 16, 2024. The Notice of Petition for Waiver or Variance was published in Vol. 50, No. 101, of the May 22, 2024, Florida Administrative Register. The Petitioner requested a waiver and variance of paragraph 64B4-3.0085(10)(a), F.A.C., entitled “Intern Registration” which requires that petitioner passed the theory and practice examination as required in Sections 491.005(1)(d), (3)(d); (4)(d), F.S. The Board considered the request at a duly-noticed public meeting held on August 8, 2024, in Naples, Florida. The Board found that the petition was in a substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. The Board denied the petition due to petitioner not passing the theory and practice examination as required by Section 491.0045(6), F.S. The Board’s Order, filed on September 6, 2024, denied the petition from Rule 64B4-3.0085, Florida Administrative Code.
