NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Timothy J. Warren on May 25, 2018. The following is a summary of the agency's disposition of the petition: The original Notice of Petition for Declaratory Statement was published in Vol. 44, No. 113, of the June 11, 2018 Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on August 10, 2018, in Coral Gables, Florida. At its meeting, the Petitioner sought the Board’s interpretation whether Petitioner, as a licensed plumbing contractor, is allowed to replace an existing back flow prevention assembly. The Board declined to issue a Declaratory Statement stating that Petitioner’s petition is facially insufficient and the Fire Marshall’s Office is under the Department of Financial Services and the Board has no authority in this matter. Further, the Board cites a possible problem with antitrust provisions because the question involves the scope of practice. The Order was filed on August 31, 2018.
