NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by S. Paizes, Florida Home Improvement Services on November 29, 2017. The following is a summary of the agency's disposition of the petition: The Florida Roofing and Sheet Metal Contractors Association, Inc. (FRSA), filed a Motion for Intervention on January 9, 2018. The following is a summary of the agency’s disposition of the petition: The original Notice of Petition for Declaratory Statement filed by S. Paizes, Florida Home Improvement Services was published in Vol. 43, No. 244, of the December 20, 2017 Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on February 16, 2018, in Orlando, Florida. At its meeting, the Petitioner sought the Board’s interpretation whether a licensed certified contractor can use an agency agreement/power of attorney agreement for any legally authorized representation of the contractor. The Board declined to issue a Declaratory Statement stating that Petitioner’s petition appears to apply to the conduct of a third party. The Order was filed on March 6, 2018.
