Notice is hereby given that the Board of Medicine has received a Petition for Declaratory Statement filed on behalf of Jose E. Garcia, M.D., on August 31, 2020. Petitioner seeks a declaration from the Board that paragraph 458.331(1)(w), subsection 458.348(1), and Sections 458.3485 and 456.47, Florida Statutes do not prohibit him or his licensed physician providers from utilizing telehealth technology to direct EMTs under paragraph 458.331(1)(w) and subsection 458.348(1), Florida Statutes, in administering medications to patients during the telehealth visit. The Board will consider this petition at its meeting currently scheduled for October 2, 2020. Except for good cause shown, motions for leave to intervene must be filed within 21 days after publication of this notice.
