    11B-35.002Basic Recruit Training Programs for Law Enforcement, Correctional, and Correctional Probation

    The Florida Department of Law Enforcement hereby gives notice:

    On February 8, 2017, the Criminal Justice Standards and Training Commission (CJSTC) issued a Final Order granting a 90-day waiver of subsection 11B-35.002(2), F.A.C., to Peter Zeman. Subsection 11B-35.002(2), F.A.C., gives individuals four years from the start of a Basic Recurit Training Program to complete specified training and examination requirements and to become employed and certified; the waiver permits Petitioner, who has completed the training and examination requirements, 90 days from the effective date of the Final Order to become employed and certified. The Petition was filed on November 17, 2016, and notice of the petition was published on December 22, 2016, in Vol. 42, No. 247, of the Florida Administrative Register. No public comments were received. In rendering its decision, the CJSTC determined that Petitioner would suffer a substantial hardship were the waiver not granted as he would be required to forego an offer of employment to complete the training, examination, and hiring process again. The CJSTC also determined that a waiver in this matter would serve the purpose of the underlying statutes as it would result in the imminent employment of Petitioner as a law enforcement officer, a position for which he is currently qualified and adequately trained.
