    The Board of Optometry hereby gives notice:

    That on September 16, 2016, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed by Nicole Yontz, on August 1, 2016, seeking a waiver or variance from subsection 64B13-4.001(2), F.A.C., regarding the requirement that applicants for licensure must have passed all 4 parts of the licensure examination within the 7 year period immediately preceding application for licensure. The Notice was published in Volume 42, No. 150, of the Florida Administrative Register, on August 3, 2016. The Board, at its meeting held on August 19, 2016, voted to deny the Petition for Waiver or Variance finding that the Petitioner did not demonstrate a substantial hardship; that application of the rule did not violate the principles of fairness; and that the purpose of the underlying statute was not met.
