    RULE NO.:RULE TITLE:

11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

NOTICE IS HEREBY GIVEN that on September 20, 2013, the Criminal Justice Standards and Training Commission, received a petition for a temporary waiver of subsection 11B-27.002(4), F.A.C., by Ismael Cartagena, Jr. Petitioner wishes to waive that portion of the rule which requires an officer to obtain employment within four years of beginning basic recruit training. The Petitioner asserts that he could not obtain employment within the four year window because of his divorce and the recent death of his mother. The Petition states that the operation of the rule would violate the principles of fairness because Petitioner had to work two jobs to support his children as a single parent after his 2011 divorce. The Petition states that the operation of the rule creates a substantial hardship for Petitioner because he has only recently passed the State Officer Certification Examination and has begun to seek employment with two agencies that appear to be interested in interviewing him as a possible candidate for employment. Petitioner seeks an additional six months from the date his four years to become employed expired, September 8, 2013, to secure employment.
