NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Kristi and Jerry Norris, Unit Owners, In Re: Juno Beach Condominium Property Owners Association, Inc., Docket No. 2014038356, filed on September 12, 2014. The petition seeks the agency’s opinion as to the applicability of Section 95.11(2), Florida Statutes, as it applies to the petitioner.
Whether Juno Beach Condominium Property Owners Association, Inc. is precluded from compelling a unit owner to remove a patio from his property that has been in place for 18 years under Section 95.11(2), Florida Statutes.
