    PURPOSE AND EFFECT: The proposed rulemaking will repeal obsolete rules.

    SUMMARY: During the 2023 Legislative Session, House Bill 1595, Law Enforcement Operations, was passed and approved by the Governor. The bill revised the budget appeal process to challenge funding reductions in a municipal law enforcement agency’s budget and transferred the budget appeal process from the Administration Commission to the Division of Administrative Hearings. The bill was approved by the Governor on May 25, 2023, Chapter 2023-156, LOF, and become effective on the same date. As a result, the Commission's rules are obsolete.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The agency's economic analysis of the adverse impact or potential regulatory costs of the proposed rule repeal do not exceed any of the criteria established in Section 120.54(2)(a), FS. The proposed repeal of the rules will not add any cost to regulated businesses of the agency. The proposed rulemaking merely repeals obsolete rules.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
