NOTICE IS HEREBY GIVEN that the Board of Massage Therapy has issued an order disposing of the petition for declaratory statement filed by Cheryl Baisley on February 23, 2017. The following is a summary of the agency’s disposition of the petition:
The Notice of Petition for Declaratory Statement was published March 1, 2017 in Vol. 43, No. 41 of the Florida Administrative Register. The petition seeks a declaratory statement from the Board as to whether live web-based courses (webinars), whereby the instructor provides live demonstrations, meet the requirements of 64B7-28.009 and thus be considered classroom hours. The Board’s Order, filed on August 30, 2017 dismisses the petition because it is not in substantial compliance with the provisions of Section 120.565, Florida Statutes, and Rule 28-105, Florida Administrative Code.
