64B8-2.001: Definitions

The Board of Medicine hereby gives notice that on September 9, 2009, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver was filed on behalf of Kishore J. Thampy, M.D. on June 8, 2009, seeking a waiver from Rule 64B8-2.001, F.A.C., with regard to the requirement for obtaining a passing score on the FLEX examination in one sitting of the examination. The Notice was published in Vol. 35, No. 24, of the Florida Administrative Weekly, on June 19, 2009. The Board, at its meeting held on August 14, 2009, voted to grant the Petition for Waiver finding that the Petitioner demonstrated a substantial hardship; that application of the rule would violate the principles of fairness; and that he has met the purpose of the underlying statute.
